On the present occasion a fitting opportunity has arisen for considering the grave question of Constitutional issues which have been raised.
They are, however, further complicated by the Law Officer's advice that in order to prevent the Judgment of the lower court from being taken as an uncontested precedent, a statement or pronouncement should be made to the effect that, in deciding to prosecute the appeal, they must not be understood as acquiescing in the Judgment, as a pronouncement of the Law.
In accordance with my instructions, I have entered a nolle prosequi in respect of the Informations still pending against the Defendant.
I may also add that His Majesty's Government have informed the Government of Portugal of the course of action determined upon, and of the reasons for its adoption.
